Rules and regulation for the 2009 Drawing 1. Description. MyInternetWindow Drawing (defined as "Drawing" in this document) is managed by MyInternetWindow.com, a division of Basamba LLC (both defined as "Survey Sponsor" in this document). Our legal address is Basamba LLC, c/o NRAI Services, Inc., 2731 Executive Park Drive, Suite 4, Weston, FL, 33331. Survey Sponsor offers different level of submission for participants and will award prizes to winners, selected in a random drawing from all eligible entries received during the Promotion Period. However Survey Sponsor will award only one (1) prize to one (1) person for any survey page of any survey and associated drawing. Furthermore pages identified as "Offer Pages" may be inserted in the survey and between "Survey Pages". Entries into the Drawing are only possible when a "Survey Page" is completed as required by the "Survey Sponsor" or when participant provides answers to the "required" survey questions or request for information such as first and last name, email address, physical address, gender, age, personal preferences and other information as requested by "Survey Sponsor". Other pages such as "Offer Pages" that are placed in between two or more "Survey Pages" and are designed to present participants with optional offers of products and services do not constitute an entry to the drawing. Typical surveys include "Survey Pages" and "Offer Pages" organized as shown in the example below: Survey Page 1 - "Survey Page" Successful submission by participant qualifies this participant for "level 1" prize Survey Page 2 - "Offer Page" where participation is optional and does not limit participant's chance to win a prize Survey Page 3 - "Survey Page" Successful submission by participant qualifies this participant for "level 2" prize Survey Page 4 - "Offer Page" where participation is optional and does not limit participant's chance to win a prize Survey Page 5 - "Survey Page" Successful submission by participant qualifies this participant for "level 3" prize Survey Page 6 - "Offer Page" where participation is optional and does not limit participant's chance to win a prize Survey Page 7 - "Survey Page" Successful submission by participant qualifies this participant for "level 4" prize Survey Page 8 - "Offer Page" where participation is optional and does not limit participant's chance to win a prize Survey Page 9 - "Survey Page" Successful submission by participant qualifies this participant for "level 5" prize Typical Survey Page 10 - Final "Thank You" page that may contain an offer or re-direct to an advertiser's web page. Participation is optional and does not limit participant's chance to win a prize While the above example of a survey describes a typical suite of pages for a survey, final organization may vary and may include more than one offer page of consecutive survey pages and are not limited to the number in the example. Finally prizes for each survey with their level may be different from survey to survey, and are listed on the first page of each survey, and possibly on all or some of the other pages including "Survey Pages" and/or "Offer Pages". Representations of the prize will be promoted through the survey websites (www.myinternetwindow.com) as well as other websites where the survey may be advertised or display in all or part. Access to the survey and entry to the drawing may be submitted through the MyInternetWindow.com site or one of its participating Affiliate websites. 2. Promotion Period. The Drawing promotion begins on July 15, 2009, at 12:00:00 pm Eastern Standard Time ("EST") and ends December 31, 2009, at 11:59:59 am EST and is defined as the "Promotion Period". All entries must be received during this Promotion Period. Winners, as defined above in 1) will be drawn on or about the 20th day of the following month. 3. How to Enter. To enter the drawing each participant must complete the required questions (required questions are identified by an asterisk (*)) in order to be entered for the drawing of the prize associated with the survey page submitted. Surveys cannot be started from any pages but rather must be started from page 1 and the other pages in continuity provided by Survey Sponsor. Participant must complete the required information on the first page of the survey to be eligible for prizes on pages 2, 3, 4, etc. In the same manner, participants must complete the required information on each page to be considered for a prize on the following "Survey Page". Finally participant cannot skip survey pages. Any deviation from this rule will disqualify participant from receiving any prizes associated with the survey they were participating in. Information provided by users who enter the drawing for each survey page must be truthful and may be verified at the time of awarding a prize. User is requested to enter his or her email address on each survey page as a way to authorize MyInternetWindow and/or its affiliate to use this information as stipulated in this document and the Privacy policy (review privacy policy by clicking here) User email address and residential address must be unique since only one prize per email address and residential address will be awarded. No PO box address for a claim or submission will be accepted and submission of a PO Box address will invalidate user's entry into the drawing of the survey where this PO Box address is entered. 4. Eligibility. THERE ARE NO PURCHASE NECESSARY TO WIN. The Drawing is open to legal residents of the fifty (50) United States (including the District of Columbia) ) who are at least eighteen (18) years of age or older. Drawing is also open to resident of Canada who are eighteen (18) or older. This offer is not available in Quebec and where similar offers are prohibited or restricted by law. To be eligible to win, surveys and associated entries must be completed by participant in the format designated in step 3 above and must be received during the promotion period defined in 3). Employees of Survey Sponsor, its parents, subsidiaries, affiliates, suppliers or their immediate families are not eligible. The total number of eligible entries received during the Promotion Period will determine the odds of winning. By entering, entrants agree to abide by these Rules and the decisions of the Survey Sponsor, which are final and binding. 5. Description of Prize. Prizes will be define for each survey and will be listed on the first page of the survey and at the survey sponsor discretion all prizes or selected prizes will be listed in some or all survey pages and some or all offer pages. 6. Drawing and Awarding of Drawing Prize. A random drawing will be conducted using all eligible and correctly completed entries received during the Promotion Period. Prizes will be awarded to a qualified winner based on their entry level as explained in 1). "Level 1" prize winner will be picked first, followed by "level 2" winner and so on until all prizes have been awarded. Only one winner per level and per survey will be selected. For example Winner of Level 1 will no longer qualify for prizes in the other level and his entry in the other level will be eliminated from the random drawing. Winner will be notified by e-mail or by certified mail, return receipt requested, within ten (10) days of the drawing. Except where prohibited, potential winner must execute and return to Survey Sponsor, within ten (ten) days of being notified, an affidavit of Eligibility, Liability and Publicity Release (or Declaration of compliance, if Canadian resident) in order to claim his/her prize. Winner will be required to complete and return an affidavit of Eligibility, Liability, and Publicity Release (or Declaration of compliance, if Canadian resident) within fourteen (14) days of attempted delivery. Failure to comply with these Official Rules, failure to execute and return the required documents within 14 days of attempted delivery or the return of the prize notification as undeliverable, will result in awarding the prize to an alternate winner. Upon alternate winner's failure to comply with these Official Rules, failure to execute and return the required documents within 14 days of attempted delivery or the return of the prize notification as undeliverable, the alternate winner forfeits the prize and no additional alternate winner shall be chosen. If a Canadian resident, the potential winner will be required to correctly answer a time-limited skill-testing question without any assistance in order to be eligible to receive the prize. If the potential winner is a Canadian resident and the question is answered incorrectly, the prize will be forfeited. All taxes are the responsibility of the winner. Entry constitutes permission to post winner's name on the Survey Sponsor's website and the use of the winner's name and hometown for purposes of advertising without further compensation unless prohibited by law. By accepting the prize, winner agrees that Survey Sponsor, its affiliates, distributors, advertising and promotional agencies and suppliers and all of their respective officers, directors, employees, representatives and agents shall have no liability for, and shall hold all such parties harmless against damage, loss or injury that may arise in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of prizes or participation in this Drawing. Offer void where prohibited. 7. Miscellaneous. Drawings are subject to all applicable laws in the United States and Canada. They are void where prohibited and in any country except the United States and Canada. Survey Sponsor may prohibit entrants from participating in the Drawing and disqualify entries if they attempt to enter the Drawing or submit Surveys' answers through means not described in the rules, attempt to disrupt Surveys, the Drawing or to circumvent the rules, act in an un-sportsmanlike manner or with an intent to annoy or harass any other entrant or Survey Sponsor(s). Survey Sponsor reserves the right to cancel or suspend the Drawing should virus, "warms" or "bugs", unauthorized human intervention, or other causes beyond the control of the Survey Sponsor, corrupt the administration, security, fairness, integrity, or proper operation of the Survey and/or Drawing. All decisions are final. Survey Sponsor makes no warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the use of the Drawing prize including, but not limited to, quality, merchantability or fitness for a particular prize. Entrants agree that any and all claims, disputes and causes of action arising out of or related to the Drawing shall be resolved, without resort to any form of class action, exclusively by the appropriate courts in West Palm Beach County, Florida in accordance with the laws of the State of Florida, without giving effect to conflict of law rules which would cause the application of the laws of any other jurisdiction. Entrants agree that drawing will take place only if no less than 3000 valid* entrants (also identified as participants) have entered the drawings at any levels (a combined total of 3000 valid* participants regardless of Level of drawing). Should this 3000 valid* entrants not be reached at the date of the drawing (December 31, 2009) then all valid participants from this drawing will automatically be entered in the next drawing schedule to start on January 1, 2010 and run until July 1, 2010. * Valid entrants means a person who has entered truthful information about their identity and provided a legitimate email address and, if required within the survey, a mailing address and related information. * Valid entrants are further defined based on the truthfulness of the information provided in order for "Survey Sponsor" to award the prize won by entrant. Should the information provided be deemed false, the entrant will be deemed ineligible and his entry be disqualified. A new drawing for the prize won by the ineligible entrant will be completed to find a new winner within the valid entrants of that Level. 8. Winner's List. Winner of the 2009 Drawing will be listed on MyInternetWindow.com website or will be provided via regular mail when requested. Addendum: Cash Incentives: Cash incentives are occasionally offered to participant of surveys in exchange for completed surveys. If you complete one of these special surveys and your eligibility is confirmed, you will be paid the determined incentive payment via PayPal. Please note that it will take up to 8 weeks to receive these funds. The funds will only be sent to the e-mail address registered on file for the participant with MyInternetWindow.com. If your e-mail address is different or has changed and funds have already been sent to your e-mail address on file, MyInternetWindow.com will not redirect the funds to your new address. MyInternetWindow.com will not make payments in any form other than PayPal. MyInternetWindow.com will not make special arrangements to issue a check to you personally, nor will it accept bill requests from participants. PayPal.com is a service that allows you to receive cash over the Internet. Cash payments will only be made after the member's qualification to participate in a particular survey has been verified by MyInternetWindow.com, and the member has completed the survey satisfactorily. MyInternetWindow.com is not responsible for lost or misplaced funds and is not responsible for any taxes due as a result of payments made to participants for their participation in MyInternetWindow.com surveys. MyInternetWindow.com is required by law to issue a Form 1099 to any member who is paid $600.00 or more for participation in surveys, for the participation of referrals, or both will request that participant provide tax information for tax reporting purposes before any payment is made.
